Debate ensues over immigration standing, custody of Rosa Jimenez simply 1 day after choose requires her launch

AUSTIN (KXAN) – A day after she was granted a new hearing that could potentially have led to her release from prison, new questions arise about which agency is holding Rosa Jimenez and what happens to her case.

Defense attorneys for the babysitter, previously convicted of the death of a child in their care, told KXAN that federal immigration officials had picked up their client from prison and they may be on their way to the Mexican border for deportation will.

This comes a day after new experts testify on behalf of Jimenez, who has been innocent for more than 15 years since she was sentenced to death of the 21-month-old man who choked on paper towels while Jimenez babysat him. These experts argued that accidental suffocation was plausible, and at the end of the hearing, District Judge Karen Sage declared that a new trial was deserved – and stated that Jimenez may even be innocent.

On Wednesday, Sara Ann Brown, Jimenez’s attorney, told KXAN that they had received news that their client had been picked up by the U.S. Immigration and Customs Service at the Mountain View Unit in Gatesville, Texas.

“She was deprived of her life for 17 years because of the judicial system, and now this is,” Brown told KXAN investigator Avery Travis, who is prosecuting the case.

Just minutes later, they received a new update that ICE may release its customers to the custody of the Mexican consulate in San Antonio later on Wednesday.

Brown said lawyers from the Innocence Project, who stand up for those who may be wrongly imprisoned, are working on the matter.

KXAN reached out to the Travis District Attorney and immigration officers for more details on Jimenez’s status.

Brown asks those concerned about Jimenez’s treatment to call their lawmakers.

On Wednesday afternoon, Travis County’s 299th District Court released the results of Tuesday’s hearing, stating, “Given the testimony and affidavits of our experts, Ms. Jimenez is entitled to relief because she is likely innocent.”
