First courtroom look listed in aggravated interference with parental custody case

Formal charges have now been filed against the grandmother of a 2-year-old Emporia child who was missing for several days, and a preliminary date for the court’s first appearance is now on the agenda.

Lyon district attorney Marc Goodman says Jessica Suzanne Downs, 41, has been charged with aggravated parental custody charges. The current plan provides for a first appearance on Monday in the District Court of Lyon.

Downs is accused of bringing Kyrese Cabrera-Downs to his birth father, 23-year-old Devin Downs, before the child was returned to his birth mother on Wednesday. Court documents made available to KVOE News indicate that the birth mother allowed Downs to visit the child on Jan. 16. The child should have been brought back on Monday morning. This followed a reported discussion in which Downs asked to have the child for a full week and it was refused. The mother told police that Downs had threatened to take the child away in the past.

Authorities first went to Devin Downs’ Augusta mobile home on Monday after Jessica Downs gave advice on how to drop off the child, but the child was absent. They then followed tips about Topeka, but that search was unsuccessful. A tip led Emporia police to an address in southwest Emporia where Jessica Downs had been arrested.

Shortly after her arrest, Jessica Downs informed officers that she had not communicated regularly with birth mother, Devin Downs, and others because, under most circumstances, she did not have WiFi access on her cell phone and the social media messages of the birth mother I ignored my mother afterwards. The mother had become belligerent. Jessica Downs also said that Devin Downs didn’t want anyone to know that he had custody of the child earlier this week and that he intended to keep the child away from their birth mother. Devin Downs denied both allegations in a separate interview with Emporia Police.

Devin Downs has been arrested on a pending arrest warrant against Lyon County for alleged non-compliance.

Friday, 6 a.m.: Grandmother was charged after the missing 2-year-old Emporia was returned

Downs is accused of bringing Kyrese Cabrera-Downs to his birth father, 23-year-old Devin Downs, before the child was returned to his birth mother on Wednesday. According to police, Jessica Downs said she gave birth to the child on Tuesday, although the 2-year-old was actually last seen on Sunday and asked Emporia police for public help late Monday.

Further details on the chain of events that lead to the discovery of the toddler are still pending.
