If a court temporarily upheld the arbitrator’s recommended order to grant a plaintiff’s mother’s request for change of custody of one of the parties’ three children, it will not be considered a defendant. MCR 3.215 (G) (3) The father claims there is no possibility of temporarily influencing the order recommended by the arbitrator that changes custody of a child.
