Omaha Man Sentenced for Involvment in Youngster Custody Dispute Altercation in Storm Lake

One of the people charged with forcibly breaking into an apartment on Oneida Street in Storm Lake last October that injured several people was sentenced to ten years suspended prison sentence by Buena Vista County District Court.

Dmytro Smith, 28, of Omaha, Nebraska, was convicted of third-degree burglary, a class C crime. Three victims of the incident personally gave statements of detention to the court. The BV County Attorney also pleaded for a prison sentence.

Smith and two others, also from Omaha, were charged with going to 227 Oneida Street over a custody battle for a minor child. Storm Lake police alleged the three people forcibly entered the house during the quarrel and assaulted several residents. One male victim suffered severe facial injuries and two female victims suffered minor injuries.

Smith was arrested by Storm Lake Police for first degree burglary, assault and child endangerment.

In addition to the suspended sentence, Smith was given three years probation with the Iowa Department of Corrections.
