Safety Plea by runaway couple: HC directs Chandigarh SSP to take custody of minor lady

When the Punjab and Haryana Supreme Court heard a request for protection from a runaway couple – a minor girl and a 28-year-old man who claimed to have married, the SSP ordered UT police to take custody of the girl and make sure she lives in Aashiana, Chandigarh until further notice.

The HC also instructed the police officer to take appropriate measures to protect the underage girl’s life and freedom from harm from her relatives and family members.

Judge Arun Kumar Tyagi’s bench heard the couple’s petition for protection.

The petitioners, who claimed to be around 17 years and 6 months and 28 years old, through their lawyer, Parampreet Singh Bajwa, alleged that they were married on June 16, against the will of the interviewees, according to Hindu rites and ceremonies in their boyfriend’s home (Family members) and understand a threat to their life and freedom.

Meanwhile, the prosecutor alleged that the girl was under 18 years of age, which falls under the definition of a child under Section 2 (a) of the 2006 Prohibition of Child Marriage Act. Section 9 of the Prohibition of Child Marriage Act, 2006, provides a penalty for a person who marries a child. He further said that petitioner No. 2 (man) was not entitled to custody of petitioner No. 1 (girl) and that the girl’s life and freedom must be protected by taking her to a childcare facility under the care of the youth welfare office is brought to committee.

The bank, which adjourned the matter until July 23, noted: “In the meantime, Senior Superintendent of Police, UT Chandigarh has been instructed to take custody of Petitioner No. 1 from Petitioner No. 2 and to ensure that except for further orders to the contrary “Petitioner No. 1 is detained in Aashiana, Sector 15, Chandigarh, and at the request of Respondents No. 4 to 6 to take appropriate measures to protect her life and her freedom from danger. All costs for the stay of Petitioner No. 1 in Aashiana, Sector 15, Chandigarh, will be borne by the UT Chandigarh. “

The HC also instructed the SSP Malerkotla to take appropriate measures to protect the life and freedom of the man at his current place of residence, insofar as this is necessary according to the perception of the threat, the facts and the circumstances of the case.

The bank has meanwhile also ordered, but nothing in this order prevents the police officers from registering a criminal case against Petitioner No. 2 (man) and taking appropriate action against him in accordance with the law, which is based on the facts and circumstances of the Case are justified.

The court also ordered that the Punjab Prosecutor and UT Chandigarh’s additional prosecutor be served a copy of the order and sent to the Senior Superintendent of Police, Malerkotla and Senior Superintendent of Police, Chandigarh, for compliance.
